All payments are NON-REFUNDABLE Final payment is due 1 month before the wedding day

ENTIRE AGREEMENT: This agreement contains the entire understanding between –DM Photography - and the -CLIENT-. It supersedes all prior and simultaneous agreements between the parties. The only way to add to or change this agreement is to do so in writing, signed by all the parties. If the parties choose to waive one provision of this agreement, it does not change any other provision. Any waivers made at the time of the signing, or agreed to prior to signing, are to be notated on the original contract.

 SERVICES RESERVATION: A complete booking (above) is required to reserve the date and time of the photographic coverage.

 STYLE SPECIFICS: It is up to the CLIENT to specify the overall desired style of shooting to be done and communicate this with –DM Photography-, it is agreed by both parties that DM Photography shall attempt to emulate the agreed-upon style. DM Photography agrees to use his/her skills, experience, and abilities to achieve a satisfactory result for the CLIENT. There is no guarantee that the final results will be exactly in line with the CLIENT’s vision, and the CLIENT recognizes that photography is an art form both subjective and variable. It is recognized by both parties that, good communication will help facilitate this, and setting aside time at the ceremony/reception for posed/group shots will facilitate a well-rounded final product. The CLIENT understands that it is their responsibility to allow and schedule sufficient time for successful documenting of their event. Written timelines/notes ahead of time are helpful in sticking to a schedule and achieving a desirable result. CLIENT’s initials acknowledge their understanding.  CLIENT is required to assign a helper to DM Photography during group shots to gather those who are to be photographed.

 SHOOTING TIME / ADDITIONS: The photography schedule and selected methodology are agreed upon by both the CLIENT and DM Photography and are designed to accomplish the stated goals and wishes of the CLIENT in a manner enjoyed by all parties. CLIENT and –DM Photography- agree that punctuality is essential to that purpose. Shooting commences at the scheduled start time. Additional time MAY be available, however, the CLIENT should not expect it with certainty. Any additional shooting time, services, or products should be expected to entail additional costs.

 HOUSE RULES: DM Photography is limited by any guidelines, or house rules, of a ceremony official (if applicable) or site management. DM Photography will abide by these limitations. It is agreed that the CLIENT is responsible for ensuring that these limitations are communicated to DM Photography in advance of the date of coverage (the earlier the better), and agrees to accept the technical results of these limitations on DM Photography, such negative effects can be but are not limited to, grainier images, limited shot selection, limited composition, and similar. Negotiation with the officials for moderation of guidelines is the CLIENT's responsibility; DM PHOTOGRAPHY will offer technical recommendations only.

 COPYRIGHT: The photographs produced by DM PHOTOGRAPHY are protected by English Copyright Law (all rights reserved) and may not be reproduced in any manner without DM PHOTOGRAPHY's explicitly written permission. Upon final payment by the CLIENT, and delivery of imagery, limited copyright release of the resulting images will be transferred to the CLIENT under the specific conditions/stipulations provided in the ‘copyright release’, and of the nature agreed to by both parties. A signed copy of the copyright release will be provided on the USB device containing any released files / digital images.

 EXHIBITION: CLIENT grants DM PHOTOGRAPHY permission to display selected images resulting from this assignment as an example of DM PHOTOGRAPHY’s work and for entrance into photographic competitions, publication, or direct printing. The CLIENT waives and releases all claims to profits, or direct profits that may arise from the use of images. It is the standard policy of DM PHOTOGRAPHY to never use such images in a negative manner, and should a specific image or the use of such an image be objectionable to the CLIENT, DM PHOTOGRAPHY Policy is to discontinue the use of such an image as soon as is practical.

 MODEL RELEASE: The CLIENT hereby grants DM PHOTOGRAPHY and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction. The CLIENT hereby releases DM PHOTOGRAPHY and its legal representatives and assigns from any and all claims and liability relating to said photographs. The CLIENT agrees that the CLIENT’s guests, spouse, family members, and attendees of the event shall be made aware of the photography taking place at this event and that they may at any time become subjects of the photographs. It is the CLIENT’s responsibility to inform attendees of this.

Weather and/or Delays

Weather permitting, the photographs will be taken as agreed. In the event of inclement weather, DM Photography, in cooperation with the client, will make the necessary changes to the schedule and will do its best to produce coverage of the wedding within the time allocated to them.

THE SCHEDULE: Our shooting schedule, style of working and experience are designed to achieve a great set of wedding photos for the bride and groom, accomplished with good humour and enjoyed by all concerned. Both the bride and groom and DM Photography, therefore, agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the wedding does not run on time (for example, extreme lateness by the bride arriving at the church) we cannot guarantee to take our normal set of photos although in such circumstances DM PHOTOGRAPHY will use their best endeavours to achieve the best results in the time that is available.

Loss or Damage of Equipment

Any loss or damage of DM Photography’s Equipment on the day that has been a direct result of DM Photography’s failure will be covered by DM Photography’s insurance.

Any Damage or loss of equipment that has been down by a fault of a guest or guests will be replaced by that person. In the case of children causing any damage to DM Photography equipment, it will be down to the parent or guardian to replace lost or damaged equipment. The Bride and Groom are responsible for explaining this to the guest in question, should this situation occur. DM Photography will provide proof of the costs of any equipment loss or damage to the bride and groom

Requested Photographs

DM Photography will honour requests for specific photographs subject to the following: weather and time permitting; availability and the cooperation of the person(s) concerned. All such requested photographs must form part of the client’s final wedding order.

PAPARAZZI WEDDING GUESTS: All your guests will have digital cameras and all your guests will want to photograph the bride and groom. In the spirit of cheerful cooperation, the bride and groom agree to give DM Photography precedence over your guests in order to take the photographs required for the wedding services described above. We cannot be held liable for a lack of wedding photos if guests taking their own photos of the bride and groom have continually interrupted DM Photography’s work.

COOPERATION: The bride and groom and DM Photography consent to happily cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. We recommend that DM Photography be provided with a helper (usually the best man) who will point out key individuals to be photographed. DM Photography may also require the assistance of the best man in organizing family groups. The bride and groom also agree to give DM Photography sufficient warning of key events at the wedding to give DM Photography time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having their photo taken. In such cases, DM Photography will use its discretion but cannot be held responsible for a lack of photos of these people.

 LIMIT OF LIABILITY: In the unlikely event that DM Photography is unable to photograph the event, for any reason beyond his control, -DM PHOTOGRAPHY- will make every reasonable effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability are limited to the return of all payments received for the photography fee. DM PHOTOGRAPHY takes great care with respect to the exposure, storage, processing and delivery of images. If, in the unlikely event photographs are lost, destroyed, or stolen for reasons within or beyond DM PHOTOGRAPHY control, DM PHOTOGRAPHY liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of the total number of originals.

If a wedding/event or DM Photography services are cancelled by the client, a cancellation fee of £250 is applied. not including the deposit

All deposits are non -refundable

Payment: Payment is required on the 1st day of the month before your wedding. EG May wedding day will be April 1st

Pre-Wedding Meetings and shoots: Pre-wedding meetings will take a place at a venue of DM Photography’s choosing and will be with the couple only and must be a weekday during the daytime

DM Photography reserve the right to change the Term and Condition anytime in the booking.
